What Happens Next?

a) Bargaining procedure

  • The employer and union will now try to agree on a bargaining procedure to cover issues such as pay, hours, holidays, etc
  • ACAS may be invited to help if both parties agree
  • If after three months no agreement has been reached the union may apply to the CAC to intervene. If the CAC cannot get both sides to agree, it may impose a statutory collective bargaining procedure, which will be legally binding on both parties.

b) Provision of Information

  • The employer will have to provide information to facilitate the bargaining process
  • This will include information about pay and benefits; conditions of service; performance issues; financial information; manpower details.
