What Is Statutory Trade Union Recognition?

The legislation was introduced by the Government as a measure to give workers in the UK basic minimum rights.

  • Individual workers now have the right to be collectively represented by an independent trade union where a majority of them wants it.
  • Employers may still recognise unions which do not hold a certificate of independence, but these unions cannot use the statutory procedure to obtain recognition.
  • Procedures are in place to help employers, the unions and workers to reach agreement and there is scope for parties to resolve their differences voluntarily at every stage.
  • The Central Arbitration Committee (CAC) is overseeing the scheme and will intervene in cases of dispute.
